Industry Profile: Barney Kilpatrick

Barney Kilpatrick is a 30-year music industry veteran who began his career working for Quint Davis at The New Orleans Jazz and Heritage Festival in 1973 while still in high school. His interest in the music business as a career intensified during his college years when he booked live music at the LSU Assembly Center and later became program director of Tulane University's campus radio station, WTUL. During this time he came in contact with industry legends like Peter Grant, Spencer Davis, Peter Rudge, Charlie Minor and Don Fox, each of whom served as an example, as least of a lifestyle in which he wanted to participate.

"The fact that Peter Grant and Peter Rudge commanded instant respect and cooperation from everyone with whom they came in contact really impressed me as a teenager," notes Barney. "Only later did I come to realize that what I witnessed had as much to do with the fact that Rudge was working with the Stones and the Who and Grant managed Led Zeppelin at the time I saw them in action--probably the three biggest acts in the business at the time. In Charlie Minor's case, his power derived almost totally from his personality. It was amazing to walk into a room full of people with him. The entire tenor of an event would change immediately. Charlie knew everyone. and everyone knew Charlie. All I could think was that I wanted to do what he did for a living."

His career included several years (1981-84) in New Orleans radio, as well as a 1984-87 stint at legendary indie label I.R.S. He is best known for his nearly 14 years at Warner Bros. Records (1987-2000), where he eventually became head of pop radio promotion, working closely with R.E.M, The Red Hot Chili Peppers, k. d. lang, The Goo Goo Dolls, Madonna, Seal, Rod Stewart, Faith Hill and many other successful acts. He also created and led the radio campaign that resulted in Cher's stunning 1999 comeback with the No. 1 single, "Believe." "It was written and produced by the same crew who did 'Ooh, Aah (Just a Little Bit)' by Gina G., which we found on our UK label and worked to No. 1 here in the U.S. in 1996," Barney relates.

In 2001 Barney formed Rattlesby Records, Inc., which has released recordings by The Radiators, The von Trapp Children, Janah and Oteil and the Peacemakers. He also operates Rattlesby Management, LLC, which oversees the careers of The von Trapp Children, rockabilly/roots band The Cigar Store Indians, sacred steel act The Lee Boys and the prestigious jazz/bluegrass fusion ensemble The Wayfaring Strangers.

He turned success at booking symphony pops engagements in 2004 for The von Trapp Children into a part-time position booking pops engagements for the Skyline Music roster, including The Machine, Al Stewart, Solomon Burke, The Wayfaring Strangers, Nancy Sinatra, Lesley Gore and Solas. Barney has booked engagements with the Atlanta Symphony, the Edison (NJ) Symphony, Phoenix Symphony, Tennessee Philharmonic, Boston Pops, Detroit Symphony, Indianapolis Symphony, Minnesota Orchestra, Baltimore Symphony, Los Angeles Philharmonic and the National Arts Centre Symphony (Ottawa, ON) with Skyline artists.

Barney recently formed a joint venture with Stephen Ambrose Historical Tours, World of Music Tours, to offer fan travel packages. Their first project, a fan tour of Europe with The Radiators, resulted in a front page story in The Wall Street Journal about creative tour financing. For that trip, 87 fans purchased travel packages which entitled them to travel on motor coaches throughout Europe, along with the band, their crew and equipment. The trip was devised out of desperation to finance a European tour and album release that otherwise would have been out of reach for the band. A wine tasting tour of central California hosted by Al Stewart is the newest project undertaken by the partners. The package offers Stewart's fans a chance to attend a private show by the British folk singer as well as to attend wine tastings and gourmet dinners hosted by the singer, whose has been profiled by Wine Spectator magazine as a noted collector and wine expert. Why did you start Rattlesby Records?
Out of disgust with the trend at the major labels to only sign acts their A&R reps thought were capable of selling a million units on first release. I spent most of my career at Warner Bros. which under Mo Ostin and Lenny Waronker excelled at signing acts and letting the act make the album it wanted to. The label's business philosophy dictated that eventually an audience would find each act if the label was able to keep the act in the marketplace long enough. WB notoriously stuck by artists such as Bonnie Raitt, Fleetwood Mac, Randy Newman and Prince through modest sales and outright commercial flops. Each artist eventually found a huge audience.

I like to think I'm doing the same thing with Rattlesby, albeit on a much smaller scale. The single most difficult thing I had to do was to learn to adjust budgets so that an album that sells only 10,000 copies can turn a profit.

I also started the company because I wanted to prove that it was possible to make money splitting the profits from an album on a 50-50 basis with the artist. Although it's great that the major labels spend marketing dollars on their acts, the fact that fewer than five percent of all signed acts ever see any royalties from their recording deals is inexcusable.

What did you learn at IRS and Warner Bros. that you have brought to Rattlesby Records?
The main things involved dedication and willingness to take chances. Michael Plen, my boss at IRS, charted "Our Lips Are Sealed," the GoGos' first hit single, working completely alone. He did it by going out on the road on a 30-day airline pass, sleeping in airport terminals and generally suffering his way through it. In that 30 days, he went to almost every pop radio station in the country and personally asked the programmers to help him. It was a feat unequalled before or since. He taught me that if you believe in a record or in an act, there are no limits to what you should be willing to do to break through the walls erected by the media gatekeepers.

At Warner Bros., the same philosophy applied. My bosses there, Stu Cohen and Russ Thyret, supported me in having the promotion staff work a single I believed in for nearly a year. The song, Paula Cole's "I Don't Want To Wait," after nearly dying on the charts repeatedly, ended up a top 5 single and the theme song of "Dawson's Creek."

Obviously I learned a great deal about managing budgets and dealing with people in a difficult and fast-paced environment. However, when I started my own company, I was shocked at how little I knew about how the record business worked outside of the marketing and radio promotion area. I had to learn so many things by trial and error--too many!

Why did you get into artist management?
The first band I signed to the label, The Radiators, was and is a great band musically--in fact, my favorite band of all time--but is an utter disaster from a business standpoint. Many of the things I tried to do to reinvigorate their career as their record label were thwarted, either by their then-manager or by the band members themselves. My experience with them made me realize two things: 1) all the label love and money in the world cannot break an act if the act does not have great, forward-thinking management; and 2) a successful marketing campaign by a label often generates more revenue on the touring side for a well-managed band than it does on the records side. I felt that I had to participate in both revenue streams if my company was to succeed financially and management allowed me to achieve that goal.

What makes a good manager?
Generally speaking, the artist should write and play the music without interference from his or her manager. A good manager should be involved in some way in everything else the artist does, either by doing it himself, hiring it done, or coordinating with the artist to make sure that someone is covering it.

The manager is clearly responsible for assembling the team--record label, booking agent, tour manager, publicist and if needed, business manager and if your income warrants, an attorney-- that will help the artist to attain his or her career goals. The manager is also responsible for coordinating that team to make sure everyone is doing what they are supposed to be doing at the right time. A good manager will step in and help any of the team members who are falling behind so as to keep everyone on schedule together.

The most important duty of a good manager is to assemble a viable marketing plan for each project, to sell the record label and booking agent on its viability and to oversee the execution and timing of each element of the marketing plan. A manager who is knowledgeable in the recording area might help with the album production process. A manager who is knowledgeable in the area of radio promotion and publicity would get more involved in those areas.

Additionally, the manager deals with fielding offers from buyers for gigs and determining what offers make sense financially. The manager also works either through the agency or on his own to find so-called "routing gigs" that enable the artist to take other gigs in a particular geographic area. The manager is responsible for submitting individual gig information to the agent and collecting the residue from the deposits taken by the agent, then deducting his own commission and expenses and forwarding any monies remaining, along with accounting, to the artist.

The manager should always be on the lookout for expanding the artist's sources of revenue, whether through pitching songs to movie and television music supervisors, looking for movie and television appearances, looking for product endorsements, commercials, etc.

The manager should also be available as a consultant and sounding board on things like the look of the act and song choices for the artist's live show, dress, etc. The manager should try to make each member of the act feel like they are a full part of the act and help them to get involved in some small way with the work of managing the act.

Finally, the manager should act as negotiator, confidante, hand-holder and general alter-ego of the act: most managers lump all this under the category of "babysitting." A good manager never lies to the act or "protects" the act by withholding critical information.

What is the appeal of The von Trapp Children?
The von Trapp Children take their audiences back to a simpler time. Older audience members love the simplicity of their show, which hearkens back to touring acts of the first half of the last century. Boomers and their school-age children are taken back to their childhood by the songs from "The Sound of Music," many of which have been arranged in four-part harmony. The children, through the fact that they are actually descended from the real Captain and Maria, provide a living connection to the past. Finally, and most important, the children have an amazing God-given gift: Their voices are absolutely sublime!

When Bruce Houghton of Skyline Music brought this act to my attention, the kids were, quite literally, passing the hat in churches, and their parents had amassed a substantial debt making an album and trying to get the kids started touring. In the three years since I became their manager and record label, they've succeeded beyond any of our wildest dreams, touring Japan, Korea, Australia, New Zealand and Europe, selling out performing arts centers throughout the United States and establishing themselves as the hottest symphony pops guests available, with more than 30 symphony dates performed or contracted for the future. They're justifiably proud of the fact that the Boston Pops booked them for four performances in December and just added four more for a total of eight!

The kids will be performing Off-Broadway for the first time in the spring and talks are currently underway for a movie deal that should be announced before the end of the year.

Rattlesby Records has been successful in establishing an alternate retail universe for their CDs. Traditional music retail has accounted for less than 25 percent of the overall sales. Our three biggest accounts are QVC, a home school textbook catalog and a large national gift shop chain. The two latter accounts don't carry any recorded music other than the von Trapps' CDs.

How is the consultancy with Skyline Music working?
When my deal with Skyline to book symphonies was first announced, there were some questions from my management clients as to whether the deal might be in their best interest. However, a year into it, my management clients are completely happy with it. In fact, the von Trapps have benefited hugely. Because I use my marketing background to help the symphonies sell tickets to the performances, which help buyers consistently tell me they get from no other agents or managers, it's safe to say the symphonies I've dealt with so far are, by and large, very happy with the way the arrangement is working. In fact, I have been told by several symphony bookers, conductors and general managers that my marketing and publicity efforts on behalf of The von Trapp Children have brought people into symphony halls for the very first time--often three generations of the same family. In a day and age when symphony attendance and finances are in decline, I can't stress how critical this is, and it's astounding that no one else is doing it!

My foremost goal for the 2006-07 symphony season is to prove that I can bring the same marketing and publicity skills to bear in helping symphonies sell tickets for performances by other Skyline acts, such as Al Stewart, The Machine, Nancy Sinatra, Lesley Gore and Solomon Burke, all of whom have truly fine pops shows.

First industry job
First paid job: I was a stage manager at the New Orleans Jazz and Heritage Festival, 1974-82 seasonal while in high school, college and law school. First full-time industry position: I was Southwest regional sales and promotion manager, then West Coast promotion manager, IRS Records, 1984-87.

Career highlights
I worked every R.E.M. album released between 1984-1999;led the radio promotion campaign that resulted in a 12-week No. 1 single, "Kiss From a Rose," by Seal; and planned and led the radio campaigns that resulted in Madonna's 1998 comeback with Ray of Light and Cher's 1998-99 comeback with "Believe."

Career disappointment
Consolidation of broadcasting and live concert promotion has virtually ruined the music business I loved so much. Radio consolidation and deregulation have resulted in oversignalled markets in which radio stations are superserving relatively small niche audiences and playing relatively few new songs. If you look at Mediabase or BDS on a typical large market radio station, it's rare to see any of them really playing more than 5-10 new songs at times and with frequency that their audience can ever hope to become familiar with them.

Consolidation in the live concert business has made it more difficult to get good opening slots for developing acts as many headliners sell entire tours, including decisions on opening slots, to promoters. It's interesting that Corin Capshaw and The Dave Matthews Band continue to buck this trend, retaining sufficient control over their touring to be able to offer musical acts opening slots at a decent wage based purely on musical merit. I wish other managers and acts had the guts to stand up for what's right in this way.

Most memorable industry experience
In December 1998, I took Cher on a three-week-long promotional tour in support of her then-new single, "Believe." Seeing an Oscar-winning movie star get up at 4 a.m. and work 20-hour days on the road with me--at the age of 51, no less- so she could have a shot at a comeback hit--then seeing that gamble pay off, really brought home to me how hard artists, even the stars, have to work for success. Mo Ostin was right: this business should be all about the artists.

Favorite team/athlete
I've been following the New Orleans Saints through 40 years of failure and adversity. That anyone in that organization can still get up and go to work every day is a constant source of amazement to me.

What friends would be surprised to learn about you
What has always surprised people who come to my home is the amount of reading and musical study that goes on there. All four of my kids play instruments as do my wife and I. Every room in our house is filled with books, most of which I've read is unusual which particularly for someone who has spent most of his career doing radio promotion.

Industry pet peeve
I really hate that the music business too often consists of artists, managers, agents and record executives, all of whom are waiting for the others on the team to break the act so they can then participate in the profits. If it's really a team effort, everyone should be exerting 100% effort to hold up his or her end!
